Sendam is operated by THE EMADKO HOUSE, registered with the Corporate Affairs Commission in Nigeria as a business name (BN 9814925), and run by its proprietor, who is the data controller. These terms apply to everyone using Sendam.

Your account

You are responsible for what is sent from your account, including anything sent by someone who obtains your password. Keep it to yourself, and tell us at support@sendam.africa if you think it has been used without your permission.

Acceptable use

Send only to people who have agreed to hear from you. Do not use Sendam for unsolicited bulk messaging, for fraud or phishing, for impersonating another business, or for anything unlawful in the country you are sending to. Sender IDs must represent a business you actually operate.

We can suspend an account that breaches this without notice, because the alternative is our delivery routes being blocked for every other customer.

What we can and cannot promise

We do not guarantee delivery. Messages pass through mobile networks we do not control, and a message can be delayed, filtered or dropped by a network, by a do-not-disturb registry or by the recipient handset. We report the status each provider gives us. Units spent on a message that a network refuses are not automatically returned; see the refund policy.

Units and payment

Sending costs units, bought in advance. The number of units a message costs depends on its length and the destination country, and is shown before you send. Prices are set on our side and can change, but units already in your wallet keep the value they were bought at.

Liability

Sendam is provided as is. Our liability for any claim is limited to the amount you paid us in the three months before it arose. Nothing here limits liability that cannot legally be limited.

Governing law

These terms are governed by the law of the Federal Republic of Nigeria, and the courts of Nigeria have jurisdiction. If you are a consumer resident in the United Kingdom or in the EU, you keep the protection of the mandatory laws of your own country and may bring proceedings there.
